Are you a business customer or a consumer?
Telecom Advisors offer guidance to consumers and, in some cases, individual entrepreneurs. Questions about other types of business subscriptions or associations fall outside the scope of Telecom Advisors’ mission.
Page summary
Telecom Advisors primarily help private individuals (consumers) but can sometimes also provide guidance to sole proprietorships. A consumer is a person who buys something for private use, even if the subscription happens to be signed as a business subscription. Telecom Advisors do not provide guidance to limited companies, partnerships, or associations.
Sole proprietorships are now covered by industry rules for ethical sales and Telekområdgivarna’s code of conduct. If you believe the rules have not been followed, contact the operator in writing or reach out to Telekområdgivarna.
Telekområdgivarna does not provide advice on limited companies, partnerships, economic associations, or housing cooperatives. Smaller companies can find some information about rules on the Swedish Post and Telecom Authority’s website.
If you as a business owner need legal advice, you can contact Advokatjouren for free consultation or check with your industry organization. Some business owners also have a seven working day right of withdrawal if the operator is part of the industry organization Kontakta.
Business owner or consumer?
The definition of a consumer according to law is “a natural person who acts mainly for purposes outside of business activities.” Therefore, if you primarily use a subscription privately, you may in some cases be considered a consumer even if the operator claims you have entered into a business subscription. You are then covered by consumer rules.
Sole proprietorships
Sole proprietorships have been covered since September 2016 by the industry’s action plan for ethical sales. From July 1, 2017, Telekområdgivarna’s code of conduct was also extended to include sole proprietorships. Since August 13, 2024, the action plan has been transformed into an Industry Agreement.
If you believe that your operator has not followed Telekområdgivarna’s code of conduct, we recommend that you notify the operator in writing. If you have questions, you can contact us for guidance. Other questions regarding sole proprietorships, however, fall outside our mandate.
Limited companies and other types of businesses
Telekområdgivarna cannot provide advice if your complaint concerns, for example, limited companies, partnerships, limited partnerships, or economic associations such as housing cooperatives or joint facilities. However, if you have a smaller company, certain rules in LEK (the Electronic Communications Act) apply to you. You can find information about this on the Swedish Post and Telecom Authority’s website.
If you need advice as a business owner, the Swedish Bar Association has a service called “Advokatjouren” where you can get 15 minutes of free advice with a lawyer on how to proceed with your case.
If you as a business owner are affiliated with an industry organization, you can also contact them to see if they offer legal advice.
If the operator or retailer is part of the industry organization Kontakta, you as a business owner may have a seven working day right of withdrawal in accordance with their ethical rules.
