Is it enough to cancel a contract over the phone?
If you terminate the contract by phone, you should ask for a written confirmation of this. Otherwise, it may be difficult for you to prove that you have terminated the contract if a dispute arises about this. Even if you can show that you called the operator, it is not certain that it will be enough because you cannot prove what was said. It is true that verbal terminations should be enforceable against the operator in the same way as written ones, but you must be able to prove that you have terminated the contract.
We therefore always recommend that you make a written termination (via email or letter) as proof that you have terminated the contract. An alternative is often to log in to “my pages” with your operator and communicate that way. You can ask the operator to send a confirmation of the termination, where the date of termination is confirmed, to your email or by letter. Always save a copy of your written termination and the confirmation of the termination.
