When should the service be delivered?

Normally, your contract specifies the delivery time that applies. If no delivery time has been agreed upon, the operator is considered delayed if the service is not delivered within a reasonable time, taking into account what is normal for a service of the same nature and scope. Reasonable time can therefore vary from case to case.

If you have received a verbal promise of a certain delivery time from a seller, it is binding. However, you may need to be able to prove that you received the promise if a dispute arises about this.

What am I entitled to if the delivery is delayed?

  • You can withhold payment (with an amount required to secure your claim). We recommend that in such a case you notify the operator in writing that you intend to withhold payment due to the delivery delay
  • Demand delivery (if it does not entail unreasonable cost or inconvenience for the operator)
  • Cancel the contract (terminate without cost for binding period, notice period, or other cost) if the delay is of significant importance to you
  • Compensation
