When am I not entitled to compensation?
In addition to the operator being able to limit your right to compensation in their general terms and conditions, you also do not have the right to compensation:
- If you cannot show that you have made a complaint about the error or delay
- If you cannot show that you have suffered a financial loss, for example with the help of receipts or certificates
- If your damage is an unlikely consequence of the error or delivery delay
- If you cannot show that you have tried to limit your damage
- For damage that is not economic (so-called non-pecuniary damage) such as personal suffering, inconvenience, time spent, pain and suffering, unless you can show that the suffering is due to a criminal attack or that you have suffered personal injury
- If the compensation concerns loss in your business and it is stated in your contract that such loss is not compensated.
